Governing Law:

This agreement and its performance shall be governed by the laws of the state of Florida, United States of America, without regard to its conflict of laws provisions. You consent and submit to the exclusive jurisdiction of the state and federal courts located in Miami-Dade County, the state of Florida, United States of America, in all questions and controversies arising out of your use of the Site and this Agreement.

WE ARE NOT LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, OR CONSEQUENTIAL DAMAGES RESULTING FROM THE USE OF, OR THE INABILITY TO USE, OUR WEBSITE OR PRODUCTS UNDER LAWS OUTSIDE OF OUR GOVERNING JURISDICTION.

Delivery and Risk of Loss:

The risk of loss and title for items purchased pass to the buyer upon our delivery to the carrier. This policy indicates that responsibility for the goods transfers from our company to the customer at the point of carrier handover.

Customs, Duties, and Additional Charges:

Customers are responsible for all duties, taxes, and customs clearance fees associated with their order. These additional costs are beyond our control and may vary by country.

Language of Agreement:

This agreement is conducted in English. Any translations provided are for convenience only. In the event of discrepancies or disputes, the English version of this agreement will take precedence.

International Returns Policy:

International orders are generally considered final and non-returnable. Exceptions, if any, are subject to our discretion and will be outlined in this section. The process for returns, if applicable, including conditions and procedures, will be detailed here. Zerafite uses Shopify Managed Markets for all international shipping through DHL or other carrier services. Transit times may vary. Please allow an additional 1–2 business days for handling. Any customs fees, duties, taxes, shipping costs, return shipping costs, handling or any other fees other than the product cost will not be refunded in the event that an international return is accepted.

Force Majeure:

We shall not be held responsible for the non-delivery or delayed delivery of products resulting from force majeure events including but not limited to natural disasters, wars, or customs delays.

Electronic Communications:

By using our website or sending emails to us, you consent to receive electronic communications from us. This includes order confirmations, notices, updates, and other types of information related to your use of our website.

Promotional Electronic Gift Card Policy

The following governs the use and terms of promotional electronic gift cards:

1. Eligibility for Promotional Electronic Gift Cards

  • Promotional electronic gift cards are offered as a complimentary gift with qualifying purchases as specified in the promotional details.

  • Customers must complete a qualifying purchase to receive a promotional electronic gift card.

2. Expiration of Promotional Electronic Gift Cards

  • All promotional electronic gift cards expire 90 days from the date of receipt.

  • The expiration date will be clearly stated in the email containing the electronic gift card. Please ensure to use your electronic gift card before this date, as expired cards cannot be reissued or extended.

3. Returns and Cancellations

  • If an order that qualified for a promotional electronic gift card is returned in whole or in part, the electronic gift card will be cancelled.

  • If the promotional electronic gift card has already been used, the value of the card will be deducted from the refund amount.

4. Usage of Promotional Electronic Gift Cards

  • Promotional electronic gift cards can be used towards the purchase of products on the Zerafite website.

  • They cannot be redeemed for cash or used to purchase other gift cards.

  • Only one promotional electronic gift card can be used per transaction unless otherwise specified.

5. General Terms

  • Promotional electronic gift cards are non-transferable and can only be used by the recipient.

  • Promotional electronic gift cards are only valid for use on the Zerafite website and are not applicable to any in-store purchases, if applicable.

  • Zerafite reserves the right to modify or cancel this promotional electronic gift card offer at any time, including adjusting the expiration period, eligibility criteria, and other terms.

Disputes:

Any dispute relating in any way to your visit to ZERAFITE or to products you purchase through ZERAFITE shall be submitted to confidential arbitration in Florida, USA except that, to the extent you have in any manner violated or threatened to violate ZERAFITE’s intellectual property rights, ZERAFITE may seek injunctive or other appropriate relief in any state or federal court in the state of Florida, USA and you consent to exclusive jurisdiction and venue in such courts.

Arbitration under this agreement shall be conducted under the rules then prevailing of the American Arbitration Association. The arbitrator’s award shall be binding and may be entered as a judgment in any court of competent jurisdiction.

To the fullest extent permitted by applicable law, no arbitration under this Agreement shall be joined to an arbitration involving any other party subject to this Agreement, whether through class arbitration proceedings or otherwise.
